Relationship of Parties

  1. The Company has no relationship to Third Parties or Users other than providing an online directory where parties can contact one another. 
  2. It is the sole responsibility of the User to establish a relationship, terms of an agreement, and warranty terms with a Third Party. 
  3. The Company does not vet or qualify any Third Party.
  4. Users should ensure Third Party is propertly insured, has Workers Compensation, provides a sufficient warranty and description of work and checks employees for a criminal background.

Limitation of Liabilities

THE COMPANY MAKES NO EXPRESS OR IMPLIED WARRANTY OR REPRESENTATION WHATSOEVER OF OR WITH RESPECT TO THE THIRD PARTY SERVICES, AND ALL SUCH OTHER EXPRESS WARRANTIES ARE HEREBY EXPRESSLY EXCLUDED. ANY IMPLIED WARRANTY BY THE COMPANY, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS, QUALITY OF WORKMANSHIP OR WARRANTY OF WORK, IS LIMITED TO THE PRICE PAID TO THE COMPANY BY THE USER AND COMMUNICATED IN WRITING TO THE COMPANY WITHIN 30 DAYS OF THE DEFECT. THE COMPANY WILL NOT BE LIABLE FOR SPECIAL, INCIDENTAL, LOST PROFIT, OR CONSEQUENTIAL DAMAGES, DIRECTLY OR RESULTING FROM THIRD PARTY ACTIONS AND ALL SUCH DAMAGES ARE EXPRESSLY EXCLUDED. THIRD PARTY OR USER AGREES THAT UNDER NO CIRCUMSTANCE WILL COMPANY LIABILITY EXCEED THE TOTAL AMOUNT PAID TO USE THE WEBSITE OR DIRECTORY FOR 30-DAYS PRIOR TO ANY CLAIM WHATSOEVER. 

Venue

ALL DISPUTES WILL BE RESOLVED IN HILLSBOROUGH COUNTY, IN THE STATE OF FLORIDA. THE CUSTOMER EXPRESSLY FORGOES ANY RIGHT TO CHANGE OF VENUE OR JURISDICTION FOR ANY REASON. THE PREVAILING PARTY WILL BE REIMBURSED FOR REASONABLE ATTORNEY FEES, COURT COSTS AND TIME AT A RATE OF $150/hr.

Some states do not allow limitations on how long an implied warranty lasts, or exclusion or limitation or incidental or consequential damages, so the above limitation or exclusion may not apply.

Media
